Below you will find the rules and specifications for your Vivaty Create entry. Please follow these rules to guarantee your entry can be included for consideration and use in Vivaty Scenes.
Creating Content
You can use Maya, 3d Max or any other 3d development software you like to create your scenes. Once you have created your scene or object, you will need to convert them to X3D for final submission. For more information on how to create content, visit our tips and tools resource.

International Content Creators
Vivaty welcomes content submissions and feedback from individuals outside the US! Unfortunately, due to potential legal issues with international contests, we are unable to consider your work for official contest prizes. However, your 3D scenes and objects will still be evaluated and could be showcased on Vivaty.com for their originality and creativity. We also welcome your early involvement in Vivaty Create to help us shape the program. So please don’t be shy, we welcome you to submit your work to vivatycreate@vivaty.com.
Vivaty Create Developer Contest – Official Rules
NO PURCHASE NECESSARY
- The "Vivaty Create" Contest (the "Contest") begins at 12:00 a.m. Pacific Time ("PT") on August 5, 2008 and ends at 11:59 p.m. PT on September 22, 2008 ("Contest Period"). The sponsor of the Contest is Vivaty, Inc., (" Vivaty "), a Delaware corporation located at 4400 Bohannon Drive, Suite 101, Menlo Park, CA 94025. The Contest is void wherever prohibited or restricted by law. The Contest is subject to all applicable U.S. federal, state, and local laws and regulations. By entering, you agree to be bound by these Official Rules and the decisions of Vivaty, which are final and binding in all respects.
- Eligibility: The Contest is offered to legal residents of the 50 United States who are at least eighteen (18) years old at the time of entry and have Internet and telephone access. Employees, producers and directors of Vivaty, their respective affiliated and subsidiary companies, advertising and promotional agencies and the immediate family members (spouse, mother, father, sister, brother, ward, daughter or son) or members of the households of such employees or directors or family members (whether or not related) are not eligible to enter or win a prize. Limit one (1) person (author) per entry. Multiple entries from the same person are permitted, but each must be submitted entirely separate from any other entry.
- To Enter: All entries (submissions) must be submitted via vivatycreate@vivaty.com and received during the Contest Period. Entries must consist of: a 3D object or scene ("Entry") in .X3D file format, maximum file size of 100k for objects and 500k for scenes which are mass market in nature (no nudity, excessive violence or other mature themes). See additional requirements above.
- By submitting an entry to Vivaty, you hereby:
- grant to Vivaty and its affiliates, subsidiaries, licensees and assigns, an irrevocable, perpetual and royalty-free right to use, reproduce, edit, display, transmit, prepare derivative works of, modify, publish and otherwise make use of the submitted entry in any and all media, whether now known or hereinafter created, throughout the world and for any purpose. In addition to other things, the rights granted to Vivaty include but are not limited to the right to censor, compress, edit, feature, affix audio/video to, and to otherwise alter or make use of the submitted Entry;
- irrevocably assign to Vivaty the right to display, modify and edit your entry for the purposes of promoting and advertising your Entry and the Contest
- agree to be bound by these Official Rules including all eligibility requirements;
- consent to the use of your name, image, likenesses, photo, voice, and biographical materials for advertising, publicity, and promotional purposes by Vivaty or a party designated by Vivaty, including but not limited to, any online announcements, without additional notice or compensation, except where prohibited by law;
- agree that the conditions of submission set forth in these Official Rules, and all documents and agreements incorporated in these Official Rules by reference, solely govern the relationship between entrants and Vivaty in connection with this Contest;
- represent and warrant that the submitted Entry does not and shall not infringe on any copyright, trademark, proprietary right, any rights of privacy or publicity of any person, or any other right of any third party, and you have the right to grant any and all rights and licenses granted to Vivaty herein, including but not limited to all necessary rights under copyright, free and clear of any claims or encumbrances;
- acknowledge and agree that Vivaty shall have no obligation to post, display or otherwise make publicly available any Entry submitted by you, and may, in its sole and unfettered discretion, remove, edit, modify or delete any Entry that you submit to Vivaty;
- understand and intend that any Entry submitted by you to Vivaty may be available for viewing, rating, review and comment on by the public, and understand that comments or ratings with which you disagree or are unhappy about may be published or otherwise become associated with any Entry you submit to Vivaty;
- waive any privacy expectations that you may have with respect to any such Entry submitted by you to Vivaty;
- agree to hold Vivaty and its affiliates, subsidiaries, licensees sponsors and assigns harmless from and against, and hereby waive any right to pursue, any claims of any nature arising in connection with the inclusion in, publication via or display on any Vivaty site, or any other use authorized under these Official Rules, of any Entry submitted to Vivaty by you.
- Vivaty assumes no responsibility for illegible, lost, delayed, misdirected or incomplete entries, system errors and failures, faulty transmissions, or other telecommunications malfunctions. Vivaty reserves the right, in its sole discretion, to cancel or suspend part or all of this Contest, if in the Vivaty’s opinion there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or integrity and proper play of the Contest. In such event, Vivaty may void any entries they suspect are at issue and award prizes from among all eligible entries received up to the date of cancellation.
- Judging Criteria: Prize winners will be chosen by a panel of judges at Vivaty based on the following criteria: creativity, originality, and performance requirements listed above. All decisions by Vivaty are final and are made in its sole discretion.
- Odds of Winning: The odds of winning depend on the number of entries and the skill and talent of the entrants.
- Prizes:
- Grand Prize: One (1) prize of $1,000 cash (US Dollars) towards a 2-night trip to the San Francisco Bay Area to meet the Vivaty founders and art team.
- Second Prize: Five (5) prizes of $200 cash (US Dollars) each.
- Third Prize: Twenty (20) Vivaty t-shirts, valued at $20 (US Dollars) each.
- Any and all taxes and other costs, fees and expenses (including any additional travel-related costs) not specifically stated within these Official Rules as being awarded are the sole responsibility of the prize recipient. Prizes may not be transferred, substituted or redeemed for cash, except at Vivaty’s sole discretion. Specifics of the prizes are in Vivaty’s sole discretion. Prizes are subject to availability and Vivaty reserves the right, in its sole discretion, to award a prize of equal or greater value if advertised prizes or a portion of the prizes is unavailable. Vivaty shall not be responsible for any travel arrangements or liable for any damages or other harm suffered during travel.
- All winners must sign, complete and return a notarized Affidavit of Eligibility and Liability/Publicity Release (except where prohibited) before receiving any prize. Non-cash prizes are not exchangeable, transferable, or redeemable for cash. For all prizes, Vivaty reserves the right to substitute a prize of equal value.
- Winners: The selected potential winners will be notified by email or telephone within seven (7) days of the close of the Contest Period. The potential winners will have seventy-two (72) hours from the moment such notification is issued to respond to such notification by following the instructions provided therein. If a potential winner timely responds to such notification, he/she may then be sent an Affidavit of Eligibility and Liability/Publicity Release by email, and must complete (except where prohibited), sign and return all required documentation within forty-eight (48) hours of issuance. If the potential winner does not reply to the notification within seventy-two (72) hours of its issuance or does not return the signed documents within forty-eight (48) hours of their issuance (if applicable), he/she is ineligible, or he/she cannot or does not comply with these official rules as determined by Vivaty, he/she will be disqualified, the prize will be forfeited, and an alternate winner may be selected, at Vivaty's discretion. In the event of noncompliance with either the rules or any of these time periods, an alternate winner may be selected at Vivaty's discretion. Vivaty has the right to revise dates and procedures mentioned in these rules.
- LIMITATION OF LIABILITY: ENTRANTS HEREBY AGREE TO RELEASE, INDEMNIFY, AND HOLD HARMLESS VIVATY AND EACH OF ITS AFFILIATES, SUBSIDIARIES, DIVISIONS, PARENT AND RELATED COMPANIES, ADVERTISING AND PROMOTION AGENCIES, EMPLOYEES, OFFICERS, DIRECTORS AND SHAREHOLDERS (COLLECTIVELY, THE "RELEASEES") FROM ANY CLAIMS, ACTIONS, INJURY, LOSS OR DAMAGE OF ANY KIND, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY OR DEATH, RESULTING FROM PARTICIPATING IN THIS CONTEST, INABILITY TO PARTICIPATE IN THIS CONTEST OR FROM THE ACCEPTANCE, POSSESSION, OR USE OR MISUSE OF ANY PRIZE AWARDED OR PARTICIPATION OR INABILITY TO PARTICIPATE IN ANY PRIZE-RELATED ACTIVITY. THIS LIMITATION OF LIABILITY IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OR DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES. PARTICIPANTS AGREE THAT RELEASEES HAVE NOT MADE NOR IS IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, STATUTORY, EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, AND FITNESS FOR A PARTICULAR PURPOSE), IN FACT OR IN LAW, RELATIVE TO THE CONTEST. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, VIVATY DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO THE WEB SITE AND VIVATY.COM SHALL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS RELATED THERETO. THESE TERMS GIVE YOU SPECIFIC LEGAL RIGHTS. THE PROVISIONS REGARDING IMPLIED WARRANTIES ARE VOID IN SOME PROVINCES WHERE IMPLIED WARRANTIES ARE PRESCRIBED BY LAW. Releasees are not responsible for lost, late, illegible, damaged, or stolen entries or submissions, or problems of any kind, whether mechanical, human or electronic. Releasees are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, inability to access a website, fraud, incomplete, garbled, or delayed computer transmissions or inaccurate transcription of entry information, whether caused by Vivaty, users or by any of the equipment or programming associated with or utilized in this promotion or by any technical or human error which may occur in the processing of submissions which may damage a user's system or limit a participant's ability to participate in the promotion. Entry materials that have been tampered with or altered are void. WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE WEB SITE OR ANY ONLINE SERVICE RELATED TO THIS PROMOTION OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, VIVATY RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. Vivaty’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. Vivaty reserves the right to disqualify entrants who violate the rules or interfere with this Contest in any manner. If an entrant is disqualified, Vivaty reserves the right to terminate that entrant's eligibility to participate in the Contest.
- Cheating: Participants agree not to knowingly damage or cause interruption of the Contest and/or prevent others from utilizing the Contest. CAUTION: ANY ATTEMPT TO DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, VIVATY MAY DISQUALIFY ANY PARTICIPANTS MAKING SUCH ATTEMPT AND VIVATY MAY SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW. This Contest and these Official Rules are governed, construed and interpreted under the laws of the State of California and any or all claims pursuant to these shall be brought in the courts of the State of California. Any provision of these rules deemed unenforceable will be enforced to the extent permissible, and the remainder of these rules will remain in effect.
